ALGEMENE VOORWAARDEN – WARM REAGARDS

1. Identiteit
Warm Reagards is een kunstenaarscollectief bestaande uit Alexia Struye en Elisa Brenters, samen of elk afzonderlijk handelend onder de naam Warm Reagards.

2. Toepasselijkheid
Deze voorwaarden gelden voor alle diensten, projecten en samenwerkingen van Warm Reagards. Klanten en partners zijn iedereen die een fotoshoot, prints, cadeaubonnen of boeken koopt, samenwerkt bij evenementen, tentoonstellingen of kunstprojecten, of werken van Warm Reagards tentoonstelt of verkoopt.

3. Artistieke vrijheid
Warm Reagards behoudt artistieke vrijheid bij de uitvoering van opdrachten en projecten, tenzij uitdrukkelijk anders overeengekomen.

4. Prijzen en betaling
Alle prijzen zijn in euro en exclusief btw, tenzij vermeld. Facturen worden betaald binnen 30 dagen. Bij laattijdige betaling kunnen intresten en kosten worden aangerekend conform de Belgische wetgeving.

5. Intellectuele eigendom
Alle door Warm Reagards gemaakte werken blijven eigendom van Warm Reagards, tenzij schriftelijk anders overeengekomen. Voor gebruik, reproductie of exploitatie is vooraf schriftelijke toestemming vereist.

6. Gebruik van foto’s en portretrecht
De geportretteerde geeft toestemming voor gebruik van foto’s voor projecten, sociale media, drukwerk, boeken, marketing en tentoonstellingen. Dit geldt voor digitale en gedrukte media, wereldwijd en voor 50 jaar, tenzij eerder ingetrokken. Intrekking kan via hello@warmreagards.com. Intrekking heeft geen invloed op reeds gepubliceerd materiaal, maar Warm Reagards zal redelijke inspanningen leveren om toekomstig gebruik stop te zetten en digitale versies te verwijderen waar mogelijk. De geportretteerde behoudt steeds zijn/haar/hun rechten onder de GDPR.

7. Aansprakelijkheid
Warm Reagards is enkel aansprakelijk bij opzet of grove nalatigheid. Eventuele aansprakelijkheid is beperkt tot het gefactureerde bedrag. Overmacht sluit aansprakelijkheid uit.

8. Annulering en wijziging
Annuleringen moeten schriftelijk gebeuren. Warm Reagards kan gemaakte kosten aanrekenen. Indien een project niet kan doorgaan, wordt een nieuwe datum of oplossing gezocht. Terugbetalingen gebeuren binnen redelijke termijn.

9. Toepasselijk recht en bevoegde rechtbank
Belgisch recht is van toepassing. Geschillen vallen onder de rechtbanken van Antwerpen, tenzij anders overeengekomen. Partijen trachten eerst minnelijk of via bemiddeling te schikken.

10. Slotbepalingen
Indien een bepaling ongeldig is, blijven de overige bepalingen van kracht.

TERMS AND CONDITIONS – WARM REAGARDS

1. Identity
Warm Reagards is an artist collective founded by Alexia Struye and Elisa Brenters, jointly or individually operating under the name Warm Reagards.

2. Scope
These terms apply to all services, projects, and collaborations of Warm Reagards. Clients and partners include anyone booking a photoshoot, purchasing prints, gift vouchers or books, collaborating at events, exhibitions, or art projects, or exhibiting/selling works of Warm Reagards.

3. Artistic freedom
Warm Reagards retains full artistic freedom in the execution of projects and assignments, unless expressly agreed otherwise.

4. Prices and payment
All prices are in euros and exclude VAT unless stated otherwise. Invoices are payable within 30 days. Late payments may incur interest and costs in line with Belgian law.

5. Intellectual property
All works created by Warm Reagards remain their property, unless otherwise agreed in writing. Written permission is required for reproduction, distribution, or commercial use.

6. Use of photographs and portrait rights
The portrayed person grants permission to use photographs for projects, social media, printed materials, books, marketing, and exhibitions. This applies to both digital and print media, worldwide, for 50 years, unless withdrawn earlier. Consent can be withdrawn anytime by emailing hello@warmreagards.com. Withdrawal does not affect already published material, but Warm Reagards will make reasonable efforts to stop future use and remove digital versions where possible. The portrayed person retains all rights under GDPR.

7. Liability
Warm Reagards is only liable in cases of intent or gross negligence. Any liability is limited to the invoiced amount. Force majeure excludes liability.

8. Cancellation and changes
Cancellations must be in writing. Warm Reagards may charge for costs already incurred. If a project cannot proceed, a new date or alternative will be proposed. Refunds, if applicable, will be processed within a reasonable period.

9. Applicable law and jurisdiction
Belgian law applies. Disputes are subject to the courts of Antwerp unless otherwise agreed. Parties will first seek an amicable settlement or mediation.

10. Final provisions
If one clause is invalid, the other provisions remain enforceable.

CONDITIONS GÉNÉRALES – WARM REAGARDS

Warm Reagards est un collectif d’artistes composé d’Alexia Struye et Elisa Brenters, agissant ensemble ou séparément sous le nom Warm Reagards.

2. Champ d’application
Les présentes conditions s’appliquent à tous les services, projets et collaborations de Warm Reagards. Les clients et partenaires incluent toute personne réservant une séance photo, achetant des tirages, bons-cadeaux ou livres, collaborant à des événements, expositions ou projets artistiques, ou exposant/vendant des œuvres de Warm Reagards.

3. Liberté artistique
Warm Reagards conserve une liberté artistique totale dans l’exécution des projets, sauf accord écrit contraire.

4. Prix et paiement
Tous les prix sont exprimés en euros et hors TVA sauf mention contraire. Les factures doivent être payées dans les 30 jours. En cas de retard de paiement, des intérêts et frais peuvent être appliqués conformément à la législation belge.

5. Propriété intellectuelle
Toutes les œuvres créées par Warm Reagards restent leur propriété, sauf accord écrit contraire. Une autorisation écrite est requise pour toute reproduction, diffusion ou exploitation commerciale.

6. Utilisation des photos et droit à l’image
La personne photographiée autorise l’utilisation de ses photos pour des projets, réseaux sociaux, supports imprimés, publications de livres, marketing et expositions. Cette autorisation s’applique aux supports numériques et imprimés, dans le monde entier, pour une durée de 50 ans, sauf retrait anticipé. Le consentement peut être retiré à tout moment en écrivant à hello@warmreagards.com. Le retrait n’affecte pas le matériel déjà publié, mais Warm Reagards fera des efforts raisonnables pour arrêter tout usage futur et supprimer les versions numériques déjà publiées lorsque c’est possible. La personne conserve ses droits au titre du RGPD.

7. Responsabilité
Warm Reagards n’est responsable qu’en cas de faute intentionnelle ou de négligence grave. Toute responsabilité est limitée au montant facturé. La force majeure exclut toute responsabilité.

8. Annulation et modifications
Les annulations doivent être faites par écrit. Warm Reagards peut facturer les frais déjà engagés. Si un projet ne peut avoir lieu, une nouvelle date ou solution sera proposée. Les remboursements, le cas échéant, seront effectués dans un délai raisonnable.

9. Droit applicable et tribunal compétent
Le droit belge s’applique. Les litiges relèvent des tribunaux d’Anvers sauf accord contraire. Les parties chercheront d’abord un règlement amiable ou une médiation.

10. Dispositions finales
Si une disposition est invalide, les autres restent en vigueur.
